I övrigt gäller Användarvillkoren.
Väsentliga ändringar meddelas i Tjänsten.

For personal data that you, as the kennel owner/user ("Controller"), enter into Breeder Hub about buyers, prospects or other individuals, you act as the data controller and Doginary ("Processor") acts as the data processor, in accordance with Article 28 GDPR.
This DPA does not necessarily apply to processing where Doginary independently determines the purposes and means of processing, such as Doginary's own account administration, security operations, billing, or compliance with legal obligations towards you as a customer. In that context, Doginary acts as an independent controller, as further described in our Privacy Policy.
This DPA governs Doginary's processing of personal data on behalf of the Controller in connection with providing Breeder Hub. It applies for as long as Doginary processes such personal data on the Controller's behalf — i.e. for the duration of the service relationship — and thereafter for the period required by applicable law or technically necessary as part of a lawful deletion process.
The processing comprises storage, organization, retrieval, display, modification, export, deletion and other operations necessary to provide the Breeder Hub functionality requested by the Controller, for the purpose of supporting the Controller's kennel operations (e.g. managing puppy buyers and prospects).
The Controller (kennel owner) is responsible for:
Doginary processes personal data on behalf of the Controller only on documented instructions from the Controller — primarily as expressed through the Controller's use of Breeder Hub's features (e.g. recording, editing, exporting or deleting information about a buyer), together with this DPA and the Terms & Conditions. Doginary will inform the Controller if, in Doginary's assessment, an instruction infringes the GDPR or other applicable data protection law, where legally permitted to do so.
Doginary ensures that persons authorized to process the personal data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality.
Doginary implements appropriate technical and organizational security measures, taking into account the nature, scope and risk of the processing, to protect personal data against unauthorized or unlawful processing and against loss, destruction or damage. Doginary does not represent any specific security standards, certifications, encryption methods, or response times beyond those actually implemented and documented by Doginary from time to time.
The Controller is encouraged to regularly use Doginary's export functionality to maintain an independent copy of important customer and kennel information. Doginary should not be treated as the sole archival repository for irreplaceable kennel or customer records. To the maximum extent permitted by applicable law, Doginary does not guarantee permanent storage or uninterrupted availability. This wording does not limit Doginary's mandatory obligations as a processor under Article 28 GDPR.
The Controller provides Doginary with general authorization to engage sub-processors to provide the Service, provided Doginary enters into an agreement with the sub-processor imposing the same data protection obligations as those set out in this DPA. Current sub-processors are listed in Annex II below. Doginary will inform the Controller via the Service or by email of intended additions or replacements of sub-processors in good time before the change takes effect, so that the Controller has the opportunity to object. If the Controller objects on data protection grounds and the parties cannot resolve the matter, the Controller may terminate the Service and have its data handled in accordance with Section 16. Doginary remains liable to the Controller for its sub-processors' performance of their data protection obligations, to the extent provided by the GDPR.
Where a sub-processor processes or transfers personal data to a country outside the EU/EEA, Doginary ensures appropriate safeguards are in place, such as the European Commission's Standard Contractual Clauses or another valid transfer mechanism under applicable data protection law.
To the extent the Controller cannot handle a data subject request directly within Breeder Hub (e.g. via editing or deletion features), Doginary shall, through appropriate technical and organizational measures, assist the Controller in fulfilling its obligation to respond to requests for the exercise of data subjects' rights under Chapter III of the GDPR.
If Doginary becomes aware of a personal data breach affecting the Controller's personal data, Doginary will notify the Controller without undue delay after becoming aware of it, and will assist the Controller with information reasonably available to Doginary so the Controller can fulfil any notification obligations under Articles 33–34 GDPR.
Doginary shall assist the Controller, taking into account the nature of the processing and the information available to Doginary, with carrying out data protection impact assessments and any prior consultation with a supervisory authority, to the extent required under Articles 35–36 GDPR and reasonable to request from Doginary.
Upon termination of the service relationship, the Controller may export its data using the Service's export functionality. Following account closure, Doginary will delete the Controller's personal data, to the extent permitted by applicable law and within a reasonable period, unless retention is required by applicable law.
Doginary will make available to the Controller the information reasonably necessary to demonstrate compliance with the obligations set out in Article 28 GDPR, and will contribute to audits and inspections conducted by the Controller or an auditor appointed by the Controller, to a reasonable extent and upon reasonable notice.
If Doginary considers that an instruction from the Controller infringes the GDPR or other applicable data protection law, Doginary will inform the Controller, to the extent legally permitted, before carrying out the instruction.
Each party's liability under this DPA is governed by the limitations of liability set out in the Terms & Conditions, to the maximum extent permitted by applicable law. Nothing in this DPA excludes liability that cannot lawfully be excluded. This DPA and the Terms & Conditions do not limit data subjects' rights under the GDPR, including the right to compensation under Article 82.
In the event of a conflict between this DPA and the Terms & Conditions, this DPA prevails with respect to the processing of personal data covered by it. In all other respects, the Terms & Conditions apply.
Doginary may update this DPA from time to time, e.g. to reflect changes in law or sub-processors. Material changes will be communicated within the Service. The version date at the top shows the latest update.
Doginary's business may in the future be sold, transferred, merged or reorganized in whole or in part. Doginary may assign this DPA, together with the service agreement, to the party that takes over the operation of the Service (the “Successor”) only if:
From the date of the transfer, the Successor steps into Doginary's place as data processor, and this DPA continues to apply unchanged between the Controller and the Successor.
If the Controller objects or terminates the service, the Controller's personal data will not be transferred to the Successor. Doginary will then handle the data in accordance with Section 16, unless applicable law requires continued storage.
Even after a transfer, processing takes place only on the Controller's documented instructions (Section 7). The transfer gives neither Doginary nor the Successor any right to use or sell the Controller's personal data for its own purposes.
If a change of ownership occurs without a change of legal entity (e.g. a share transfer), Doginary will inform the Controller where the change affects the processor's identity, contact details, security or sub-processors. Changes of sub-processors resulting from a change of ownership are handled in accordance with Section 11.
Doginary is responsible for processing that took place before the transfer and the Successor for processing thereafter, unless mandatory law or another written agreement provides otherwise. Security incidents are handled under Section 14 by the party that is the processor at that time.
Personal data that Doginary processes as a data processor is not disclosed in identifiable form to prospective buyers in connection with due diligence.
This DPA remains in effect for as long as Doginary processes personal data on the Controller's behalf, and terminates automatically when the Terms & Conditions cease to apply or when all such processing has ended, in accordance with Section 16 above. A transfer under Section 22 does not terminate this DPA; it then continues to apply in accordance with that Section between the Controller and the Successor.
